A car fire after a crash creates terrifying moments and often causes the worst injuries. You might escape the initial impact only to face flames spreading through your vehicle. Georgia law lets you sue car makers when fuel system defects cause fires after collisions. Understanding when fires show design flaws helps you identify everyone responsible for your injuries.

When fires after crashes indicate a defective vehicle

Certain fire patterns after crashes suggest problems with how companies designed or built your car. For example:

Fuel tank placement: Car makers sometimes put fuel tanks in spots that offer poor protection during rear-end or side crashes, which lets even moderate impacts rupture the tank and start fires.

Fuel line failures: Defective fuel lines may break during minor collisions that should not cause fires, which shows the maker used cheap materials or poor design.

Electrical fires: Batteries placed near crash zones or faulty wiring can create sparks that light fuel vapors or other materials inside your car.

Missing safety features: Your car may lack fuel shut-off valves or fire suppression systems that could stop or slow fire spread after impacts.

Car makers must design vehicles to handle foreseeable crashes without turning into fire traps that burn occupants.

Building a product liability case after a fire

Proving the car maker caused your fire injuries requires specific evidence that shows design or manufacturing defects.

Get professional fire investigation reports that identify where the fire started

Research whether other drivers had similar fires in your vehicle make and model

Check for maker recalls or service bulletins about fuel system problems

Gather crash analysis showing the impact was not severe enough to cause fires in properly designed cars

Someone familiar with Georgia product liability law and car defects might help you investigate whether the maker shares responsibility beyond the driver who hit you.

Fires after collisions often result from preventable design defects rather than unavoidable crash damage. You may have valid claims against both the other driver and the car maker in Georgia.

The skull is thick and strong, but it may also contribute to the progression of a brain injury after physical trauma occurs.

Car crashes can cause traumatic brain injuries (TBIs) through a variety of different means. Some people strike their heads on the windows or steering wheels of vehicles. Other times, the aggressive motions of a vehicle can cause TBIs by causing bleeding or inflammation of the brain.

Without medical intervention, the pressure inside the skull may slowly increase, producing worsening symptoms. Many people adjusting to life after acquiring TBIs or caring for a family member with a car crash TBI discover that insurance cannot cover all of their losses. Why do TBIs frequently cost more than the amount of coverage available from an automotive insurance policy?

1. Significant medical expenses

Moderate to severe TBIs typically do not lead to full recoveries. However, people still require intensive medical intervention when they first arrive at the hospital.

Surgery is often necessary. Health care professionals may put an individual into a medically induced coma. There are also rehabilitative services to consider. Brain injury medical care can add up to tens of thousands of dollars or sometimes even millions of dollars in total lifetime medical expenses.

2. Reduced income

People who miss weeks of work to undergo medical care may lose out on thousands of dollars in regular income. Their injuries can also leave them incapable of continuing in the same career. Some people may never be able to work full-time again after acquiring a TBI. Lost income and reduced earning potential can add hundreds of thousands of dollars to the lifetime financial impact of a TBI.

3. Accommodation expenses

Brain injuries can affect everything from personality and memory to motor function. Individuals with TBIs may need to make significant adjustments to their homes and vehicles. Those changes can cost tens of thousands of dollars.

Working with an attorney may make it easier for people to estimate their losses and evaluate insurance coverage while adjusting to life with catastrophic car crash injuries. Filing a lawsuit is sometimes necessary in cases where injuries are likely to generate lifetime losses that exceed available liability insurance coverage.

The force involved in a car crash is sufficient to cause a spinal cord injury. Some people realize they have sustained an injury immediately after a crash. They cannot exit the vehicle or feel their lower extremities. They can notify first responders of their symptoms and secure appropriate medical treatment.

Others might not be aware at first that they sustained a spinal cord injury. They could leave the scene of the crash without receiving medical care. That oversight on their part could lead to a worse long-term outcome.

Incomplete spinal cord injuries are common

Immediate paralysis after a car crash is likely the result of a complete spinal cord injury. The physical trauma sustained during the collision severs the spinal cord, leading to a total loss of sensation and function.

People can also sustain incomplete spinal cord injuries. The violent motions of the vehicle during the crash could tear or pinch the spinal cord. People may not be aware of their injuries, especially if they experience a stress response that covers up their initial pain symptoms.

An incomplete spinal cord injury requires stabilization and treatment. It can cause permanent functional challenges even with proper care. Additionally, if people do not receive timely care, they could be at risk of worsening an incomplete spinal cord injury.

Incomplete injuries don't just disappear. Some injuries heal with time. Others can cause lasting medical complications. An incomplete spinal cord injury has the potential to suddenly worsen with little advance notice.

Someone who falls and jerks their body in response could worsen an incomplete spinal cord injury. Intense exercise or even a physical altercation with another person could result in the abrupt worsening of an incomplete spinal cord injury.

Instead of recovering lost function, a person with an untreated incomplete injury might suddenly develop paralysis and related symptoms. Any indication of numbness, tingling or other unusual physical sensations in the lower extremities could be indicative of an incomplete spinal cord injury following a collision.

Recognizing that spinal cord injuries vary in severity and can worsen after an initial trauma could help people better handle the aftermath of a recent wreck. People with catastrophic car crash injuries require timely medical care. They may also need help as they seek compensation for their medical expenses and lost wages, and that’s okay.

At your most vulnerable moment—perhaps lying in a hospital bed or struggling through rehabilitation—an insurance adjuster may present a settlement offer. The figure might seem substantial until you calculate the true cost of your recovery.

For victims of serious motor vehicle accidents, recognizing when an offer falls short is the first step toward securing proper compensation.

Why offers can seem unfair

Significant injuries typically involve extensive medical treatments and lost income. Your daily life can change profoundly after a severe collision.

Insurance companies, however, aim to manage their financial liabilities. So, they might initially propose a sum that does not reflect your claim's full worth. They may anticipate that you will accept a quick, smaller payment.

Georgia law and your compensation

Georgia uses an "at-fault" system for vehicle accidents. This system means the driver who caused the accident is liable for the resulting harm. The at-fault driver's insurance should provide for your healthcare costs, income lost due to inability to work and damages for physical and emotional distress.

Georgia's "modified comparative negligence" principle means that if you are found to be 50% or more responsible for an incident, you cannot be compensated for your damages. If your fault is less than 50%, your compensation decreases by your percentage of fault. These legal points directly affect the amount of compensation you could obtain.

Steps to take after a low offer

A low offer does not force your acceptance. You can take specific actions to pursue the fair compensation you deserve. Consider these important actions:

Do not feel pressured to accept the initial offer quickly

Secure copies of all documentation that relates to your accident and injuries

Assess your present medical needs and anticipate future care requirements

Keep notes on how your injuries impact your daily activities

Consult an experienced personal injury attorney

A personal injury attorney has insight into how insurance companies operate and a strong grasp of Georgia's legal system. They can precisely calculate your claim's value, including all your losses. This legal support helps you concentrate on your healing process.

Trucks are massive vehicles. Semi-trucks themselves can weigh several tons empty, and when fully loaded, their weight increases. Thus, large trucks are not just large in width — they're large as well in terms of weight.

When these wide, weighty trucks are on the road, they generally either reach their destination safely or, in some cases, experience issues ranging from minor disruptions to serious accidents, posing a significant risk to passenger vehicles.

Greatest risk: Those inside passenger vehicles

Studies indicate that 66% of fatalities in large truck crashes involve occupants of cars and other passenger vehicles. This is primarily due to the immense size and weight difference between trucks and cars.

Fully loaded trucks can weigh up to 80,000 pounds, far exceeding the weight of most passenger vehicles. Also, because the truck is tall and the clearance is low, there's a risk that a car can be crushed under the truck's trailer during a collision.

The difference in scale between trucks and passenger vehicles can lead to various dangerous collisions, such as underride accidents. If a truck drifts into a passenger vehicle's lane or collides with it, those in smaller vehicles face a high risk of fatality.

Common truck-passenger vehicle accidents

Some of the most common and potentially devastating accidents include:

Underride accidents: Passenger vehicles sliding underneath the truck's trailer

Override accidents: Trucks driving over passenger vehicles

T-bone collisions: Impacts at intersections

Jackknife accidents: The truck's trailer swinging out to the side

There's an even greater danger due to factors such as trucks' longer braking distances and the potential for driver fatigue from long hours on the road. Once a mix of these elements is present, a collision is nearly unavoidable.

What passenger vehicle drivers can do in dangerous situations

When sharing the road with large trucks, passenger vehicle occupants can take several precautions to enhance their safety. First and foremost, maintaining a safe following distance from trucks should be the norm. This allows more time to react if the truck suddenly brakes or maneuvers unexpectedly.

When passing a truck, avoid staying beside them for longer than necessary. Instead, remember these points:

Pass at a steady, safe speed without lingering at the side of the truck.

Merge back only when you see the whole truck in your rearview mirror.

Always use turn signals to communicate your intentions clearly.

Exercise extra caution in adverse weather conditions.

If you find yourself in a potentially dangerous situation with a truck, remain calm and focused. If possible, safely reduce your speed and create more distance between your vehicle and the truck. In extreme cases, it may be safer to carefully pull off the road rather than remain in a hazardous position near the truck.

Catastrophic accidents and compensation

Remember, truck drivers are professionals, but they face challenges due to their vehicle's size and weight. It's important to stay alert, avoid distractions and practice defensive driving techniques. When catastrophic accidents happen, personal injury law can help victims seek rightful compensation.

Still, unless people follow the steady stream of recalls issued each year by the National Highway Traffic Safety Administration (NHTSA) or by the vehicle manufacturers themselves, they'd be surprised to learn how many serious injuries and deaths are caused by defective automotive manufacturers' designs or the faulty parts they use. These defects are the reason for recalls, but the follow-through to fix the issue remains elusive even when a problem is identified.

The deadly defects of 2024

In 2024, several car manufacturing defects continue to cause tragic accidents and passenger deaths. Here are some of the most significant issues:

Faulty airbags: Airbags save lives when they work properly, but they can be deadly when they don't. In 2024, Chrysler and Dodge recalled nearly 285,000 cars because their side curtain airbag inflators either didn't deploy during a crash or deployed unexpectedly, sending shrapnel into the vehicle cabin.

Brake failures: Some cars experienced issues where the brakes would not engage properly, leading to accidents. This defect was perilous because it often occurred without warning, leaving drivers unable to stop their vehicles in time to avoid collisions.

Steering problems: In some cases, the steering wheel would lock up or become unresponsive, making it impossible for drivers to control their vehicles, leading to several fatal high-speed accidents.

Unintended acceleration: Some vehicles had problems with unintended acceleration, where the car would suddenly speed up without the driver pressing the gas pedal. This defect caused numerous accidents as drivers struggled to regain control of their speeding vehicles.

Electrical system failures: Modern vehicles are complex computers on wheels operated by electricity regardless of whether they still have an internal combustion engine. In 2024, there were reports of cars catching fire due to electrical system failures. These fires often started while the vehicle was in motion, giving passengers little time to escape.

Seatbelt failures: Seatbelts are the original safety feature, but they still fail, and the consequences can be dire. Some cars had seatbelts that would not latch properly or would unlatch during a crash, leading to passengers being thrown from their seats and suffering fatal injuries.

Fuel system leaks: Fuel system defects, such as leaks, can cause fires and explosions. In 2024, there were still incidents where fuel leaks led to deadly car fires. These leaks were often due to faulty fuel lines or connectors.

Did this happen to you?

These defects highlight the importance of regular vehicle maintenance and staying informed about recalls. Nonetheless, defects remain a troubling issue that causes severe injuries or worse. Victims and their families need to remember this if they are considering a lawsuit against manufacturers.

Whether it results in mild injuries or more serious ones, car accidents are serious matters, and you must make sure you do not have any lingering injuries, which can happen.

Brain injuries

Many people involved in car accidents end up with a brain injury. Some of these injuries are detected shortly after the accident and some much later, which is why this type of injury requires you to be observant and make sure you advocate for yourself if you start showing symptoms.

Symptoms

If you lose consciousness at any point, it can lead to a brain injury, and you should communicate what you experienced and how it felt to your doctor as soon as possible.

Likewise, if you begin having headaches out of nowhere after the accident or if one part of your headaches, it could be a sign of a problem with your brain.

While more challenging to recognize, if you present changes in your personality (other people in your life may approach you about this), confusion or lack of orientation while walking, all are also signs of a potential brain injury.

If you begin having trouble sleeping or feel that your extremities get numb or tingle, you should also contact your doctor immediately and explain why you are concerned so they know what to look for.

It is crucial to seek medical attention right away if you are showing signs of a brain injury following a car accident that was someone else's fault and to have a lawyer who can handle your case should you decide to take legal action.

Imagine you're cruising down the highway, the sun warm on your face, when suddenly another car veers into your lane. You brace for impact, trusting the safety features in your vehicle to protect you. But then, a malfunction occurs. The airbags, designed to be your shield, deploy with such force they cause serious injuries.

This isn't just a hypothetical scenario. Faulty airbags are a genuine danger on the road, and the consequences can be devastating when they fail.

The different faces of airbag failure

While airbags are a crucial safety element in modern vehicles, their effectiveness hinges entirely on proper functioning. Unfortunately, defective airbags can malfunction in several ways, leaving drivers and passengers vulnerable to serious injuries.

Airbag malfunction can take a few different forms, including:

Non-deployment: In a collision where an airbag should deploy, it remains stubbornly inert. This leaves occupants exposed to the full brunt of the impact, increasing the risk of head-on injuries, broken bones and internal bleeding.

Delayed deployment: Precious milliseconds can mean the difference between a minor bump and a life-threatening injury. When airbags deploy too late, they offer little to no protection.

Aggressive deployment: Airbags inflate with incredible force, a fact that's usually beneficial. However, a malfunctioning airbag can deploy with excessive force, causing facial fractures, eye injuries and even internal organ damage.

Shrapnel deployment: In the most horrifying cases, faulty manufacturing can lead to metal fragments or other debris being ejected from the airbag compartment during deployment, inflicting additional injuries.

These malfunctions can have life-altering consequences. The National Highway Traffic Safety Administration (NHTSA) keeps a record of airbag recalls, and staying informed can be a matter of life and safety.

Why legal action matters

When a malfunctioning airbag causes serious injury, the burden shouldn't fall solely on the victim. Taking legal action against negligent manufacturers sends a powerful message. It holds them accountable for their mistakes and ensures they prioritize safety in their designs and manufacturing processes.

A personal injury lawyer who focuses on product liability can help navigate the legal complexities of an airbag failure case. Here's what you can expect:

Investigating the cause: Your lawyer will meticulously investigate the accident, analyze the airbag system and work with experts to determine the cause of the malfunction.

Building a solid case: Evidence will be gathered, including police reports, medical records and data on the specific airbag model.

Seeking compensation: You may be entitled to compensation for medical expenses, lost wages, pain and suffering, and even punitive damages in cases of egregious negligence.

Taking legal action isn't just about financial compensation; it's about making our roads safer for everyone. By holding manufacturers accountable, we encourage them to prioritize safety and prevent similar tragedies from occurring in the future.

A driver could suddenly swerve into your lane too quickly without signaling or be momentarily distracted and collide with your vehicle. Minor situations can leave you unscathed, but more serious crashes can result in these injuries.

Whiplash

Whiplash is one of the most common injuries from motor vehicle accidents. It occurs when a person’s head jolts sharply forward and then back upon impact and can cause pain, stiffness, headache and limited range of motion. Usually, those involved in rear-end collisions are most likely to sustain this injury. Whiplash often clears up on its own within a few weeks.

Broken bones

Depending on the severity of an accident, victims can suffer simple or compound fractures. The former causes a clean break, but the latter results in out-of-place bone penetrating the skin. Broken arms and ribs are the most likely of these injuries to occur.

Lacerations and soft tissue injuries

Lacerations and other soft tissue injuries occur in crashes when a person comes into contact with broken glass or metal. It can also happen when loose objects in the vehicle go flying and strike the occupant. Although some of these injuries are minor and can heal quickly, others are worse and require surgery.

Brain injuries

Car accidents can cause traumatic brain injury when a person hits their head on the dashboard or a window or when something breaks and penetrates their skull. Mild concussions are the most common form of this injury, but in severe crashes, it’s possible to suffer permanent brain damage.

Spinal injuries

Spinal injuries stemming from car accidents are often catastrophic and can result in damaged or broken vertebrae, limited range of motion and chronic pain. In the worst-case scenario, a victim can be left paralyzed from the waist down or neck down.

Data from the National Highway Traffic Safety Administration’s Fatality Analysis Reporting System reveals that speeding is the most common cause of fatal motor vehicle accidents in Georgia and around the country. The number of deadly crashes involving excess speed has risen sharply in recent years. In 2019, 8,650 road users lost their lives in speed-related traffic accidents. In 2021, the speed-related death toll was 11,057. Speeding was a factor in 29% of all accident fatalities in 2021 and claimed the lives of 33 road users every day.

Speed-related accidents

The NHTSA considers motor vehicle accidents to be speed-related when one of the drivers involved was cited for speeding, exceeding the posted speed limit, racing, or traveling too fast for prevailing road conditions. According to the FARS data speeding is a particularly serious problem in the District of Columbia. Between 2012 and 2021, almost half of the deadly traffic accidents in the nation’s capital involved a driver who was speeding. In Georgia, 17.6% of the fatal accidents that took pace in 2020 were speed-related.

Risk factors

Closer scrutiny of the NHTSA data reveals that some road users are far more likely to lose their lives in speed-related accidents. Motorcycle riders are more likely to be killed in traffic accidents involving excess speed than passenger vehicle drivers, and men crash while speeding more often than women. The data also shows that young male drivers are the demographic group that is most likely to be killed in speed-related accidents. In 2021, more than 30% of the male drivers under the age of 25 who were involved in fatal accidents were speeding when they crashed. Among female drivers under the age of 25, that figure was 19%.

More rigorous policing

Many experts believe that the worrying rise in speed-related traffic deaths is largely due to reckless driving habits that motorists developed when travel restrictions and stay-at-home orders emptied the nation’s roads starting in 2020. If these experts are correct, more rigorous policing and harsher penalties for dangerous driving could help to solve the problem. When the consequences of reckless behavior are severe and the chances of being pulled over are high, drivers tend to behave more responsibly.
